Terms & Conditions for Online Sales & eBay, Amazon, Facebook Sales

1. AGREEMENT
1.1 An agreement is made between uBuyOz/uBuyOz1 and the buyer for the purchase of the product/s and/or service/s as specified in an order (“agreement”) it covers services we provide to individual customer and businesses, online auction sales, “Buy Now” Sales and Pickup Sales from our shop.
1.2 The agreement comprises the order, the order confirmation, these terms & conditions and any additional terms as specified.
1.3 Please read these terms & conditions carefully. When you engage our services or buy any item from this site or in person from our shop (not available), you are deemed to have accepted these terms & conditions, and will be bound by the Agreement, as amended and varied by us from time to time.
2. PRICE
2.1 The price payable by the buyer to uBuyOz/uBuyOz1 for the service/s and/or product/s is the price specified on our website.
3. PAYMENT
3.1 Full payment of the price is required at the time of order placement and/or when the item/s is picked up from our shop (not available).
3.2 Under this agreement, the payment processing services for goods and/or services purchased on the Website can be through direct transfer of funds into our financial institution, direct credit card payment via phone or on pickup from our shop (not available), cash payment on pickup from our shop (not available) and payment through PayPal. Extra charges for payment through certain credit cards and PayPal may apply, buyer notified of such charges when making the payment.
3.3 Direct credit card payment/s will be processed via NAB Eftpos; these terms are an agreement between the buyer and uBuyOz, Rear Shop @ 65A Katrina St. Blackburn Nth, VIC 3130. For any other type of purchases, these terms are an agreement between the buyer and uBuyOz/uBuyOz1.
3.4 uBuyOz now offers the safest and instant bank payment system called PayID, it is free of charge service offered by most if not all financial institutions, to make a payment using PayID all you have to do is log into your financial institutions website as normal and make payment through your financial institutions PayID system leaving your order number as reference. Why pay through PayID, because the payments are instant and it is safe as you are not providing your actual account number or BSB, other big advantage is that your purchase will be shipped quickly as the payment is confirmed instantly.
4. CANCELLATION FEES
4.1 If your order is cancelled, all monies received will be returned excluding the applicable cancellation fee and delivery charges incurred by uBuyOz/uBuyOz1.
4.2 A cancellation fee of 20% will apply to most cancelled orders.
4.3 No cancellation fee applies to orders placed through this website ubuyoz.com.au
4.4 Third party websites like eBay, Amazon, Facebook purchases will also attract a 20% third party purchase fee.
5. RE-STOCKING FEE
5.1 If buyer returns an item, all monies received will be returned excluding the applicable re-stocking fee.
5.2 Re-stocking fee of 20% applies to all returned items.
5.3 No Re-stocking fee applies when item is purchased through this website ubuyoz.com.au
6. DELIVERY
6.1 Delivery fees and charges may apply to any purchased item from uBuyOz/uBuyOz1, details of which will be provided by uBuyOz/uBuyOz1 when item is purchased and agreed with the buyer prior to any order being completed and paid by the buyer.
6.2 uBuyOz/uBuyOz1 will organize through couriers and Australia Post to deliver the product/s purchased to the location specified within metropolitan Melbourne, Sydney, Adelaide, Perth, Tasmania and Brisbane as well as selected regional areas. uBuyOz/uBuyOz1 may at its sole discretion elect to deliver the product/s to a location beyond those selected regions and will contact the buyer if any extra out of area charges apply, buyer must pay these extra charges before item is shipped or ask us to cancel the order.
6.3 All International orders will incur additional delivery cost based on the buyers country, our website does not calculate delivery charges on checkout for international purchases, we will notify the buyer of these additional delivery charges after the order is received or buyer should contact us to get a delivery quote before buying from us. These additional delivery charges must be paid by the buyer before the order is shipped. International buyer takes full responsibility for the item once it leaves our premises and/or we have provided the buyer with tracking number for the purchase.
6.4 uBuyOz/uBuyOz1 is unable to facilitate the delivery to all locations Australia wide, certain remote zones are non-deliverable zones. uBuyOz/uBuyOz1 will notify you of such prior to shipping your order. In such circumstance we ask that you contact us on info@ubuyoz.com.au or +61 418 311 808 before purchasing.
6.5 uBuyOz/uBuyOz1 engages couriers or Australia Post to deliver your purchased item, delivery could be to buyer’s door or buyer might have to pick the item up from a pickup point, like Australia Post shop and/or courier depot, milk bar, etc, at their (buyers) own expense.
6.6 The purchased item will remain at the pickup point like Australia Post shop and/or courier depot, milk bar, etc for limited days (7 days), after this time the item will be returned to uBuyOz/uBuyOz1. Once the item is returned to uBuyOz/uBuyOz1, the buyer must pay an additional delivery cost to have the item re-shipped to their nominated address.
6.7 All purchases from uBuyOz/uBuyOz1 can be delivered to the buyers nominated address with or without signature. By buying from uBuyOz/uBuyOz1 the buyer gives authority to leave without a signature the item in a safe place at the nominated address. The buyer takes full responsibility for the item once the item is left at the nominated address by Australia Post or courier.
6.8 uBuyOz/uBuyOz1 will deliver the purchased item in accordance these terms and conditions. The risk of loss or damage to the product/s passes to the customer upon delivery. Notwithstanding this, uBuyOz/uBuyOz1 will provide the customer with 3 days’ notice from delivery to instruct uBuyOz/uBuyOz1 of any damage to the product/s. Within this period, uBuyOz/uBuyOz1 will remedy the damage, provided that the product/s has not been installed and in all circumstances the buyer at their own cost must return the damaged item with all packaging before any remedy is provided for the damaged item.
6.9 uBuyOz/uBuyOz1 takes all steps to have your purchased item delivered as quickly as possible to your nominated address but does not guarantee any delivery time, uBuyOz/uBuyOz1 only provides delivery estimates, please do not purchase any item from uBuyOz/uBuyOz1 if you would like a guaranteed delivery time.
6.10 In most cases uBuyOz/uBuyOz1 provides via email to the buyer a tracking number for delivery of the purchased item, it is buyer responsibility to be at the delivery address when the item is delivered or pickup the item from Australia Post shop and/or courier depot, milk bar, etc (see 6.5 for time limits).
6.11 If the buyer accepts delivery of the product/s and subsequently changes their mind about the product/s (including where the buyer orders the incorrect product), the buyer has 7 days to notify uBuyOz/uBuyOz1.
uBuyOz/uBuyOz1 may, at its discretion, agree to:
- Accept return of the relevant product/s from the buyer, when item returned is in original condition; and/or
- Provide replacement product/s to the buyer.
In these circumstances, the buyer must pay:
- A re-stocking fee of 20% of the price of the product/s returned, except when purchased through this website ubuyoz.com.au; and
- Any difference between the price of the product/s being returned and the replacement product/s selected.
- Buyer to pay all return costs for purchased item.
- The buyer acknowledges that this re-stocking fee represents the costs incurred by uBuyOz/uBuyOz1 in accepting and re-stocking the returned product/s.
- uBuyOz/uBuyOz1 will not impose the re-stocking fee where the buyer is not at fault.
7. CLICK AND COLLECT FROM OUR SHOP
7.1 Click and Collect now available from Rear Shop @ 65A Katrina Street, Blackburn North, VIC 3130, Enter Via Caroline Street. Click and Collect time: 9am to 5pm Monday to Friday.
7.2 Once item is paid for the buyer will receive a text message (if purchased from this site) or if purchased from a third party website like eBay then the buyer will receive a message through the third party website. All click and collects are from Rear Shop @ 65A Katrina Street, Blackburn North, VIC 3130, Enter Via Caroline Street.
7.3 The buyer must inspect the item/items purchased on pickup, uBuyOz/uBuyOz1 does not and cannot take any responsibility for the item/items, once it is removed from our shop/premises by the buyer.
7.4 While all the effort is made to supply the correct item/items on pickup, it is buyers responsibility to inspect the item/items purchased on pickup, to make sure correct item is supplied.
7.5 By collecting and removing the item/items from our shop/premises, the buyer acknowledges that the item/items was/were received in condition described in the listing when the item was purchased.
7.6 The buyer assumes all responsibility once the item/items has/have been collected from our shop.
8. RETURNS
8.1 All returns must be made within 7 days of invoice/shipping date.
8.2 All returns attract a 20% re-stocking fee, as per clause 5.1 & 5.2, except when purchased through this website ubuyoz.com.au
8.3 All cancellations, whether the purchased item is shipped or not will attract 20% cancellation fee, as per 4.1 & 4.2, except when purchased through this website ubuyoz.com.au
8.4 No returns, no refunds, no exchanges or no credit will be provided by uBuyOz/uBuyOz1 if the item bought from this online site or from our shop (not available) is not installed by a qualified & registered trades person.
8.5 All returned items must be in original condition and must be returned in their original packaging.
8.6 All returned item are checked for the condition they are in before and refund is processed.
8.7 Buyer is responsible for the return postage cost of any returns including items to be replaced under warranty.
9. PRODUCT INSTALLATION
9.1 All items bought from uBuyOz/uBuyOz1 should be installed by a qualified & registered trades person, failing to have the item installed by a qualified & registered trades person will void the warranty, failing to have the item installed by a qualified & registered trades person will also void any faulty goods claim.
9.2 No returns, no refunds, no exchanges or no credit will be provided by uBuyOz/uBuyOz1 if the item bought from this online site or from our shop (not available) is not installed by a qualified & registered trades person.
9.3 All electrical parts like switches, elements, motors, thermostats, pcb boards and display units must be installed by a qualified & registered trades person (electrician) to qualify for warranty and faulty goods claims, we would require the buyer to provide details (name, phone and registration number) of the qualified & registered trades person before warranty or faulty goods claims are accepted.
10. WARRANTY
10.1 All electrical parts bought from uBuyOz/uBuyOz1 come with 3 month warranty.
10.2 All electrical parts like switches, elements, motors, thermostats, pcb boards and display units must be installed by a qualified & registered trades person (electrician) to qualify for warranty and faulty goods claims, we would require the buyer to provide details (name, phone and registration number) of the qualified & registered trades person before warranty or faulty goods claims are accepted.
10.3 No warranty applies if any electrical parts like switches, elements, motors, thermostats, pcb boards and display units are installed by a non qualified trades person or the buyer cannot provide us the details (name, phone and registration number) of the suitably qualified & registered trades person who installed the purchased item.
10.4 All gas parts like, gas regulators, LPG Jets, Natural Gas Jets, cooktop burner parts or any other gas parts, must be installed by a qualified & registered trades person (gas plumber) to qualify for warranty and faulty goods claims, we would require the buyer to provide details (name, phone and registration number) of the qualified & registered trades person before warranty or faulty goods claims are accepted.
10.5 No warranty applies if any gas parts like, gas regulators, LPG Jets, Natural Gas Jets, cooktop burner parts or any other gas parts are installed by a non qualified trades person or the buyer cannot provide us the details (name, phone and registration number) of the suitably qualified & registered trades person who installed the purchased item.
10.6 No warranty applies to perishable or breakable item like, rubber door seal for ovens, dishwashers, fridges and washing machines, all door glass, general glass, light globes, light globe covers, filters, grease filters, fabric filters, aluminum filters.
10.7 No warranty applies to wire racks, rack side supports, oven trays, rear fan covers, burner caps, burner crowns.
10.8 Some warranties are applicable through the manufacturer of the product, the buyer will have to contact the manufacturer for all warranty claims.
11. FAULTY GOODS CLAIM
11.1 All faulty goods claims for any electrical parts like switches, elements, motors, thermostats, pcb boards and display units must be accompanied by details (name, phone and registration number) of the suitably qualified & registered trades person who determined the purchased item to be faulty.
11.2 No faulty goods claim will be processed if any electrical parts like switches, elements, motors, thermostats, pcb boards and display units is installed by a non qualified trades person or the buyer cannot provide us the details (name, phone and registration number) of the suitably qualified & registered trades person.
12. REFUNDS, CREDITS & EXCHANGES
12.1 Please allow 1-5 working days processing time for refunds, credits and exchanges.
